Those gains could <a href=\"https:\/\/www.cnbc.com\/2023\/02\/18\/heres-how-to-lower-your-tax-bill-after-selling-a-profitable-home.html\">trigger a tax bill<\/a> this season, depending on the size of the windfall, experts say.<\/p>\n<p>In 2023, home sellers made a $121,000 profit on the typical median-priced single-family home, <a href=\"https:\/\/www.attomdata.com\/news\/most-recent\/attoms-year-end-2023-u-s-home-sales-report\/\" target=\"_blank\" rel=\"noopener\">according to ATTOM<\/a>, a nationwide property database. That&#8217;s down from $122,600 in 2022.\u00c2\u00a0\u00c2\u00a0<\/p>\n<p>But sometimes profits exceed the IRS limits for tax-free gains and &#8220;it&#8217;s a shock&#8221; for sellers, said certified public accountant Miklos Ringbauer, founder of MiklosCPA in Los Angeles.\u00c2\u00a0<\/p>\n<\/div>\n<div class=\"group\">\n<div class=\"RelatedContent-relatedContent\" id=\"SpecialReportArticle-RelatedContent-1\">\n<div class=\"RelatedContent-container\">\n<div class=\"RelatedContent-nonCollapsibleContent\">\n<h2 class=\"RelatedContent-header\">More from Smart Tax Planning:<\/h2>\n<div class=\"group\">\n<p>Here&#8217;s a look at more tax-planning news.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>Still, &#8220;the tax laws were written to encourage homeownership,&#8221; and many sellers qualify for a tax break, Ringbauer said. \u00c2\u00a0<\/p>\n<p>Single homeowners can shield up to $250,000 of home sales profit from capital gains taxes and married couples filing jointly can exclude up to $500,000, provided they meet<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/p523.pdf\" target=\"_blank\" rel=\"noopener\"> IRS eligibility<\/a>.<\/p>\n<p>If you&#8217;ve owned the property for more than one year, profits above $250,000 and $500,000 are subject to long-term <a href=\"https:\/\/www.cnbc.com\/2023\/02\/15\/heres-how-much-you-can-make-in-2023-and-pay-0percent-capital-gains-taxes.html\">capital gains taxes<\/a>, levied at 0%, 15% or 20%, depending on your 2023 taxable income.\u00c2\u00a0(You calculate &#8220;taxable income&#8221; by subtracting the greater of the standard or itemized deductions from your adjusted gross income.)<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline0\"\/>Who qualifies for the capital gains exemptions<\/h2>\n<div class=\"group\">\n<p>There are strict rules to qualify for the $250,000 or $500,000 capital gains exclusions, Ringbauer warned.\u00c2\u00a0<\/p>\n<p>The &#8220;ownership test&#8221; says you must own the home for at least two of the past five years before your home sale \u00e2\u0080\u0094 but that&#8217;s only required for one spouse if you&#8217;re married and filing jointly.<\/p>\n<\/div>\n<div class=\"group\">\n<p>There&#8217;s also a &#8220;residence test,&#8221; which requires the home to be your primary residence for any 24 months of the five years before sale, with <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/p523.pdf\" target=\"_blank\" rel=\"noopener\">some exceptions<\/a>. (The 24 months of residence can fall anywhere within the five year period, and it doesn&#8217;t have to be a single block of time.)<\/p>\n<p>Both spouses must meet the residence requirement for the full exclusion.<\/p>\n<p>A <a href=\"https:\/\/www.irs.gov\/publications\/p523#en_US_2023_publink100073096\" target=\"_blank\" rel=\"noopener\">partial exclusion<\/a> may also be possible if you sold your home because of a workplace location change, for health reasons or for &#8220;unforeseeable events,&#8221; according to the IRS.<\/p>\n<p>Generally, you can&#8217;t get the tax break if you received the exclusion for the sale of another home within two years of your closing date.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline1\"\/>How to reduce your home sale profits<\/h2>\n<div class=\"group\">\n<p>If your capital gain exceeds the IRS exclusions, it&#8217;s possible to reduce your profits by increasing your home&#8217;s original purchase price or &#8220;basis,&#8221; according to certified financial planner Assunta McLane, managing director of Summit Place Financial Advisors in Summit, New Jersey.<\/p>\n<p>You can increase your home&#8217;s basis by adding <a href=\"https:\/\/www.irs.gov\/publications\/p523#en_US_2023_publink100010755\" target=\"_blank\" rel=\"noopener\">certain improvements<\/a> you&#8217;ve made to the property to &#8220;prolong its useful life,&#8221; according to the IRS.<\/p>\n<p>For example, you could tack on the cost of home additions, updated systems, landscaping or new appliances.\u00c2\u00a0But the cost of repairs and maintenance generally don&#8217;t count.<\/p>\n<\/div>\n<div role=\"region\" aria-labelledby=\"Placeholder-ArticleBody-Video-107365955\">\n<div role=\"button\" tabindex=\"0\" id=\"Placeholder-ArticleBody-Video-107365955\" class=\"PlaceHolder-wrapper\" data-vilynx-id=\"7000329881\" data-test=\"VideoPlaceHolder\">\n<div class=\"InlineVideo-videoEmbed\" id=\"InlineVideo-0\" data-test=\"InlineVideo\">\n<div class=\"InlineVideo-wrapper\">\n<div class=\"InlineVideo-inlineThumbnailContainer\"><img decoding=\"async\" class=\"InlineVideo-videoThumbnail\" src=\"https:\/\/image.cnbcfm.com\/api\/v1\/image\/107365962-1706560114527-1706559635467-2024_your_money_home_office_deduction_1080p_.jpg?v=1706560116&amp;w=750&amp;h=422&amp;vtcrop=y\" alt=\"2024 Tax Tips: Home office deduction\"\/><span class=\"InlineVideo-videoButton\"\/><span\/><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>Of course, you&#8217;ll need detailed records to show proof of capital improvements, because &#8220;estimates don&#8217;t work <a href=\"https:\/\/www.cnbc.com\/2024\/02\/13\/here-are-some-of-the-top-red-flags-for-an-irs-audit-tax-pros-say.html\">when it comes to an audit<\/a>,&#8221; Ringbauer said.<\/p>\n<p>After a home sale, the IRS receives a copy of <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-1099-s\" target=\"_blank\" rel=\"noopener\">Form 1099-S<\/a>, which shows your closing date and gross proceeds.
