The last thing you or the other tenants want is to hear an emotional support canary singing at 3 am.\u00a0<\/span><\/p>\n<p><b>If the animal is or becomes disruptive at any time, you can SUGGEST training or behavior lessons before filing for eviction. <\/b><span style=\"font-weight: 400;\">The keyword here is <\/span><i><span style=\"font-weight: 400;\">suggest<\/span><\/i><span style=\"font-weight: 400;\">; you cannot require your tenant to get their ESAs to training.\u00a0<\/span><\/p>\n<p><b>However, landlords can file for eviction if the animal continues to be disruptive or dangerous. <\/b><span style=\"font-weight: 400;\">What\u2019s important here is, like always, to document everything you can so that, if worse comes to worse, you have proof that can support your eviction.\u00a0<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Charging_Additional_Fees\"\/><b>Charging Additional Fees<\/b><span class=\"ez-toc-section-end\"\/><\/h3>\n<p><b>No, as per the Fair Housing Act, landlords cannot charge additional fees for emotional support animals. <\/b><span style=\"font-weight: 400;\">Since emotional support animals are not considered pets, you cannot charge the tenant an additional pet fee, refundable pet deposit, or ongoing pet rent.\u00a0<\/span><\/p>\n<p><b>However, if the animal causes any damage or harm to the property, you can deduct that amount from the initial security deposit. <\/b><span style=\"font-weight: 400;\">Ensure that the tenant is fully aware of their responsibility regarding damage done to the unit by the animal within the lease contract.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Deny_A_Tenant_Due_To_Insurance_Noncoverage_For_ESAs\"\/><b>Deny A Tenant Due To Insurance Noncoverage For ESAs<\/b><span class=\"ez-toc-section-end\"\/><\/h3>\n<p><span style=\"font-weight: 400;\">Unfortunately, <\/span><b>even if your insurance doesn\u2019t cover emotional support animals, you cannot use it as grounds to reject a tenant. <\/b><span style=\"font-weight: 400;\">This falls within reasonable accommodations, but, again, you can always charge the tenant for any damages their ESA inflicts on your property.\u00a0<\/span><\/p>\n<h3\/>\n<h2><span class=\"ez-toc-section\" id=\"When_Landlords_Can_Reject_an_Applicant_with_an_ESA\"\/><b>When Landlords Can Reject an Applicant with an ESA<\/b><span class=\"ez-toc-section-end\"\/><\/h2>\n<p><span style=\"font-weight: 400;\">Even though landlords are usually legally required to allow an emotional support animal, some circumstances allow for the rejection of the animal. Examples include:<\/span><\/p>\n<h3\/>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Smaller multiunit (2-4 unit) buildings where one of the units is occupied by the owner (e.g. <\/span><a href=\"https:\/\/sparkrental.com\/live-free-house-hacking-case-study\/\" data-wpel-link=\"internal\" target=\"_self\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">multifamily house hacking<\/span><\/a><span style=\"font-weight: 400;\"> landlords).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Single-family homes rented without a real estate agent, by landlords owning three or fewer single-family rentals.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the size of the animal is not compatible with the size of the property.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the request becomes financially unreasonable for the landlord to make the accommodations for the emotional support animal.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the animal is considered potentially dangerous to other tenants living in the same building or complex.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the tenant does not meet all the typical <\/span><a href=\"https:\/\/sparkrental.com\/tenant-screening-renter-screening\/\" data-wpel-link=\"internal\" target=\"_self\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">tenant screening<\/span><\/a><span style=\"font-weight: 400;\"> qualifications required before signing a lease agreement. Usually these would include credit, criminal, and eviction histories, income, rent payment history, and beyond.\u00a0<\/span><span style=\"font-weight: 400;\"\/><\/li>\n<\/ul>\n<h2\/>\n<h2><span class=\"ez-toc-section\" id=\"How_to_Handle_Tenants_Scamming_Fair_Housing_Laws\"\/><b>How to Handle Tenants Scamming Fair Housing Laws<\/b><span class=\"ez-toc-section-end\"\/><\/h2>\n<p><span style=\"font-weight: 400;\">In a perfect world, no one would abuse laws designed to protect the disabled.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Unfortunately, there are plenty of renters who don\u2019t suffer from a disability who take advantage of Fair Housing laws to game the system.<\/strong> Scamming websites offer fake certifications or documentation stating that the animal is a service animal when it is not.\u00a0<\/span><\/p>\n<p><b>Don\u2019t expect much in the way of legal protections against these scammers. <\/b><span style=\"font-weight: 400;\">If you ask the tenant screening questions outlined above and the tenant and animal meet the qualifications, you have little choice in the matter.
