{"id":12672,"date":"2024-08-01T23:20:44","date_gmt":"2024-08-01T23:20:44","guid":{"rendered":"https:\/\/imsfund.com\/?p=12672"},"modified":"2024-08-01T23:20:44","modified_gmt":"2024-08-01T23:20:44","slug":"say-yes-to-the-dress-hayley-paige-noncompete-devastating","status":"publish","type":"post","link":"https:\/\/imsfund.com\/index.php\/2024\/08\/01\/say-yes-to-the-dress-hayley-paige-noncompete-devastating\/","title":{"rendered":"&#8216;Say Yes To The Dress&#8217; Hayley Paige: Noncompete Devastating"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Before you say &#8220;yes&#8221; to that dream job, you better read the fine print.<\/p>\n<p>Noncompetes, which <a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/non-competes.pdf\">stop employees<\/a> from starting their own businesses in the same industry and working for a competitor for a set period after the employment ends, can be devastating, says wedding dress designer Hayley Paige Gutman.<\/p>\n<p>Gutman <a href=\"https:\/\/www.banking.senate.gov\/imo\/media\/doc\/paige_testimony_7-25-24.pdf\">shared her testimony<\/a> with a Senate economic policy subcommittee on Monday, three-and-a-half years after the start of a noncompete legal battle with her former employer, JLM Couture,<b> <\/b>and three months after the U.S. Federal Trade Commission <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/04\/ftc-announces-rule-banning-noncompetes\">announced a new rule<\/a> banning noncompetes.<\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"lazyload\" loading=\"lazy\" role=\"presentation\" src=\"https:\/\/assets.entrepreneur.com\/images\/misc\/1722534968_Hayley-Paige-GettyImages-1156772262.jpg?width=1000\" style=\"height:667px; width:1000px\" width=\"1000\" height=\"667\"\/><br \/><i><sup>Hayley Paige. Photo by Dia Dipasupil\/Getty Images for Runway Heroes<\/sup><\/i><\/p>\n<p>Gutman was not allowed to work in wedding dress design for five years after leaving her employer because of the noncompete.<\/p>\n<p>&#8220;I could start over with a new name, I could open new social media accounts and rebuild, but I could not work in my chosen craft,&#8221; Gutman said.<\/p>\n<p>The FTC <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/04\/ftc-announces-rule-banning-noncompetes\">estimates<\/a> that around one in five Americans, or about 30 million people, are under noncompetes. According to the agency, banning the agreements would add 8,500 new businesses a year and increase wages for the average employee by $524 per year.<\/p>\n<p>The noncompete ban was set to take effect starting <a href=\"https:\/\/www.seyfarth.com\/news-insights\/ftc-non-compete-ban-what-you-need-to-know.html#:~:text=the%20Federal%20Register.-,The%20effective%20date%20of%20the%20Final%20Rule%20is%20September%204,accrues%20before%20the%20effective%20date.\">September 4<\/a>, but <a href=\"https:\/\/www.cnbc.com\/2024\/07\/08\/judge-partially-blocks-ftc-noncompetes-ban-what-it-means-for-workers.html\">legal challenges<\/a> could delay, or even cancel, its implementation.<\/p>\n<p><b>Related: <a href=\"https:\/\/www.entrepreneur.com\/business-news\/selena-gomez-shuts-down-rumors-says-not-selling-rare-beauty\/474988\">Selena Gomez Says She Isn&#8217;t Selling Her $2 Billion Beauty Company<\/a><\/b><\/p>\n<p>Opponents of the ban, however,<b> <\/b>say businesses <a href=\"https:\/\/www.testgorilla.com\/blog\/pros-cons-non-compete-agreements\/\">could benefit<\/a> from noncompetes because employees can&#8217;t use what they learned to start rival companies. The agreements also help protect trade secrets and retain employees for longer periods.<\/p>\n<p>In her testimony, Gutman detailed how she signed an employment contract with a noncompete clause in 2011, at the age of 25, with JLM Couture. Nine years later, JLM alleged that Gutman had violated the noncompete by using the @misshayleypage social media accounts, which had more than a million followers, to promote other companies without JLM&#8217;s permission.<\/p>\n<p>JLM <a href=\"https:\/\/www.businessinsider.com\/hayley-paige-gutman-jlm-couture-controversy-timeline-2021-1\">also claimed<\/a> that the company was the reason for Gutman&#8217;s social media fame, and appearances on TLC&#8217;s &#8220;Say Yes to the Dress&#8221; and &#8220;Say Yes To America&#8221; reality TV shows only happened because Kleinfeld Bridal, where &#8220;Say Yes to the Dress&#8221; is filmed, is one of JLM&#8217;s biggest clients.<\/p>\n<p>&#8220;I spent every dollar I ever earned designing wedding dresses to fight for my right to do so once again,&#8221; Gutman said in her testimony, adding later, &#8220;I want to demonstrate how noncompetes operate shamelessly on a one-way highway: if we are not limiting competition among corporations, why are we limiting it among individuals?&#8221;<\/p>\n<blockquote cite=\"https:\/\/www.tiktok.com\/@sheischeval\/video\/7397890845971615022\" class=\"tiktok-embed\" data-video-id=\"7397890845971615022\" style=\"max-width: 605px;min-width: 325px;\"><p><a href=\"https:\/\/www.tiktok.com\/@sheischeval?refer=embed\" target=\"_blank\" rel=\"noopener\">@sheischeval<\/a><\/p>\n<p>Let a girl design a dress ?????<\/p>\n<p><a href=\"https:\/\/www.tiktok.com\/music\/original-sound-7397890828544379690?refer=embed\" target=\"_blank\" rel=\"noopener\">\u266c original sound &#8211; CHEVAL\u2002|\u2002Shoe\u2002Designer<\/a><\/p><\/blockquote>\n<p>Gutman and JLM ultimately <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/wedding-dress-makers-hayley-paige-jlm-settle-lawsuit-over-breakup-2024-05-28\/\">reached a settlement agreement<\/a> in May that gave her the rights to the &#8220;Hayley Paige&#8221; name and social media accounts.
